Terms of Use

1. Eligibility and accounts

Accounts are for WASZP sailors, coaches and staff invited into the USFoil HUB network. Athletes under 18 require parent or guardian consent, given through the consent process in the Platform. You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. USFoil may approve, decline, suspend, restrict or delete any account, HUB membership or team membership at any time, for any reason or no reason, without notice or liability.

The Platform also issues restricted accounts: guest accounts created with a USFoil event code, endorsement-pathway accounts for coaches who are not attached to a HUB, and sponsor accounts. Each is limited to the features made available to it, event codes expire, and USFoil may withdraw any restricted account at any time. Guest sailors self-track their skills and are not eligible for certification sign-off until they join a HUB.

2. Media, data and publicity release

You irrevocably grant USFoil a perpetual, worldwide, royalty-free, fully paid, transferable, sublicensable and unrestricted right and licence to use, reproduce, distribute, display, perform, edit, adapt and create derivative works from your data, content, training and performance records, name, likeness, image, voice, photographs and video, in any and all media now known or later developed.

You further expressly authorise USFoil to share all such data, photographs and video with FOILFAST, WASZP, KA Sail, their parent, subsidiary and affiliated companies, distributors, licensees, sponsors, class associations and other related entities, with no limits on purpose, medium, territory, duration or frequency, and you grant those entities the same rights described above.

You also authorise ordinary sharing with other outside organisations as described in the Privacy Policy. You waive any right to inspect or approve any use, any claim for compensation, royalties or attribution, and any claim based on privacy, publicity, defamation, moral rights or similar grounds arising out of such use. You confirm you have the rights necessary to grant this release for any content you upload, and — where the athlete is under 18 — the parent or guardian grants it on the athlete’s behalf.

3. Acceptable use

Do not upload unlawful, harassing, infringing or misleading content; do not falsify training, fitness, regatta or certification records; do not attempt to access other users’ data, circumvent security, event codes or approval controls, scrape the Platform, or use it to compete with USFoil. Coach assessments, sign-offs and certification decisions may only be entered by the coach they are attributed to, no one may assess or sign off their own sailor certification, and no coach may assess, approve, sign off or issue their own USFoil Dinghy Foiling Coach Endorsement.

4. Messaging

The Platform carries messages between coaches, sailors and sponsors. Messages are not private: USFoil may review them, messages to a HUB copy that HUB’s coaches, messages to a race team copy USFoil-wide coaches, sponsor messages copy USFoil-wide coaches, and every message sent or received by an athlete under 18 copies their parent or guardian. Messages and attachments are retained indefinitely. Use messaging only for sailing, coaching and programme purposes; do not use it to harass, solicit or market to athletes. Sponsors may not contact sailors who have not written to them first.

5. Sailor certifications and coach endorsements

Sailor certifications, levels, badges and certificates issued through the Platform reflect USFoil’s internal assessment of a sailor’s demonstrated skills at a point in time.

A USFoil Dinghy Foiling Coach Endorsement is a sport-specific endorsement recording that a coach has completed and demonstrated the requirements of a USFoil coaching level. It is not a professional licence, teaching credential, safety certification or background screening, and it does not verify any third-party credential. Current underlying credentials and endorsement status should be independently verified.

Scope. An endorsement covers dinghy foiling coaching within the USFoil programme only. It carries a stated Valid Through date, and only an endorsement in “Active” status represents a current endorsement. USFoil may issue, amend, renew, suspend, reinstate or revoke any certification or endorsement at its sole discretion.

No employment or agency. An endorsement does not create an employment, agency, partnership or joint-venture relationship between USFoil and any coach. Endorsed coaches are not employees, agents or representatives of USFoil, and USFoil does not direct, supervise or control their coaching work.

Club and organisation responsibility. Clubs, HUBs, schools, camps, event organisers and any other organisation engaging a coach remain solely responsible for hiring decisions, supervision, insurance, staffing levels, safety planning and for independently verifying every coach’s identity, qualifications, background screening and current credentials. USFoil makes no representation or warranty about a coach’s fitness for any role.

6. Not medical or safety advice

Fitness targets, training content, exercise descriptions and coaching material are general information only, not medical, health or safety advice. Consult a qualified professional before beginning or changing any training programme. Sailing, foiling and physical training carry inherent risks of serious injury or death; you knowingly assume all such risks and are solely responsible for your own safety and decisions on and off the water.

7. Intellectual property

The Platform, its curriculum, checklists, certification and endorsement frameworks, text, design and software are owned by USFoil and its licensors and are protected by copyright. You may not copy, distribute, publish or create derivative works from them without our prior written permission.

8. Disclaimers

The Platform is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted, error-free or secure operation, or that data will not be lost. We may change, suspend or discontinue any part of the Platform at any time.

9. Limitation of liability

To the fullest extent permitted by law, USFoil and its officers, directors, coaches, volunteers, affiliates and the entities named in Section 2 will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, personal injury or death, arising out of or relating to the Platform. Our total aggregate liability for any claim will not exceed one hundred US dollars (US$100).

10. Indemnity

You agree to indemnify, defend and hold harmless USFoil and the entities named in Section 2 from any claims, damages, losses and expenses (including legal fees) arising out of your use of the Platform, your content, or your breach of these Terms.

11. Changes and governing law

We may modify these Terms at any time; continued use after a change constitutes acceptance. These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict of law rules, and you consent to the exclusive jurisdiction of the state and federal courts located there. If any provision is held unenforceable, the rest remains in effect.
